Before filing your application, it important to ensure that you have met the grounds for divorce. After the introduction of no-fault divorce, you are not required to give reason for the relationship break down, it is only required that your marriage has broken down and there is no reasonable likelihood that you will get back together. In addition to this, legislation requires the parties to have been separated for at least twelve (12) months before filing for divorce. It is important to note that you may be separated even if living under the same roof.

However, if you have been married for less than two years from the date of marriage to the date of application, the court also requires mandatory counselling with a family counsellor to explore the possibility of reconciliation.

An application for divorce may either be filed online, or by completing an application for divorce and sending it with all required documents, such as a marriage certificate, to a family law registry. Once the application has been filed, a copy must be served on the other party according to the guidelines of the Federal Magistrates Court.
