Children’s Court – Care and Protection

When concerns have been raised about the care and protection of a child or young person under the age of 18 years, the Children’s Court has the power to make court orders to ensure their safety, welfare and well-being.

To commence proceedings in the Children’s Court regarding the care and protection of a child, an application must be filed at a Children’s Court registry. Applications may be made in regards to the emergency care and protection of a child, the allocation of parental responsibility, contact with a child and much more.

Where the Children’s Court is satisfied that the child or young person is need of care and protection, a variety of orders may be put in place to ensure their safety.

During the proceedings, the court takes all measure practicable to ensure that the child or young person has the opportunity to be heard and participate in the proceedings, and will also ensure that the child understands and decisions or rulings.
